2008 Ballot Issue I-158

THE COMPLETE TEXT OF INITIATIVE NO. 158

BE IT ENACTED BY THE PEOPLE OF THE STATE OF MONTANA:

NEW SECTION. Section 1. Purpose. In order to increase public access to wildlife for the purpose of pursuing and harvesting wild fish and wild game owned by the citizens of the State of Montana, the act provides that no person shall directly or indirectly inhibit access to wild fish and wild game by directly or indirectly entering agreements to buy, sell, trade, barter, or offer to buy, sell, trade or barter for access to land.

NEW SECTION. Section 2. Public access to land for purposes of pursuing and harvesting wild fish and wild game. A person shall not directly or indirectly inhibit the public’s access to pursue and harvest wild fish and wild game by entering into agreements to sell, buy, trade, barter, or offer to buy, sell, trade or barter for access to land. The department of Fish Wildlife and Parks by rule may provide a notice regarding this act on any license issued.

NEW SECTION. Section 3. Codification. [Section 1 and Section 2] are intended to be codified as an integral part of Title 87, chapter 3, part 1, and the provisions of Title 87, chapter 3, part 1, apply to [sections 1 and 2].

NEW SECTION. Section 4. Saving clause. This act does not affect rights and duties that matured, penalties that were incurred, or proceedings that were begun before the effective date of this act.

NEW SECTION. Section 5. Severability. If a part of this act is invalid, all valid parts that are severable from the invalid part remain in effect. If a part of this act is invalid in one or more of its applications, the part remains in effect in all valid applications that are severable from the invalid applications.

NEW SECTION. Section 6. Effective date. This act is effective upon approval by the electorate.
